Consequential damages are not recoverable unless the breaching party had reason to know of the special circumstances. These damages are also called special damages or indirect damages., Gross negligence - heightened degree of negligence representing an extreme departure from the ordinary standard of care. Falling between intent to do wrongful harm and ordinary negligence, this type of negligence is defined as willful, wanton, and reckless conduct affecting the life or property or another., Willful misconduct - an act or omission that is taken— (i) intentionally to achieve a wrongful purpose; (ii) knowingly without legal or factual justification; and (iii) in disregard of a known or obvious risk that is so great as to make it highly probable that the harm will outweigh the benefit.
