Advantages of Mediation: Both the set-up and resolution can be made quickly., It is more cost-effective than litigation., It is flexible and allows the parties to form a creative settlement., The parties are assisted by a neutral third party., The proceedings are confidential and private., It prevents adverse precedent by the courts., It avoids stress and trauma to the parties., Even if it does go to court, the parties have a better understanding of each others’ case., Disadvantages of Mediation: Cases ending up in court would incur extra costs., If forced into it by court order, it could be seen as an obstacle to achieving an answer., Compulsory mediation could lead to little commitment from the parties., In matrimonial disputes there may not be a level playing field., There is a low take-up rate., The government has been slow to promote mediation.,
