1.1 Your use of the Wordwall website at wordwall.net (the "Website") and any Wordwall products, channels, software, data feeds and services, provided to you on or from or through the Website by Wordwall (collectively the "Service"). "Wordwall" means Visual Education Ltd., a company registered in England and Wales under company number: 05900439. Wordwall can be contacted by:

1.2 These Terms of Use form a legally binding agreement between you and Wordwall in relation to your use of the Service (the "Terms"). It is important that you take the time to read them carefully.
1.3 The Terms apply to all users of the Service, including users who are also contributors of Content, on the Service. "Content" includes the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials you may view on, access through or contribute to the Service.
1.4 We do not intend that children should create an account with Wordwall. However, children may be users of the Service.
2.1 In order to use the Service, you must firstly agree to the Terms. You may not use the Service if you do not accept the Terms.
2.2 You can accept the Terms by simply using the Service. You understand and agree that Wordwall will treat your use of the Service as acceptance of the Terms from that point onwards.
2.3 You may not use the Service and may not accept the Terms if (a) you are not of legal age to form a binding contract with Wordwall, or (b) you are a person who is either barred or otherwise legally prohibited from receiving or using the Service under the laws of the country in which you are resident or from which you access or use the Service.
3.1 Our Website Privacy Policy and Cookie Policy also applies to your use of the Website. This Policy explains how we collect, use and store your personal data and sets out information about the cookies on the Website.
4.1 Wordwall reserves the right to make changes to the Terms from time to time, for example to address changes to the law or regulatory changes or changes to functionality offered through the Service. A modified version of the Terms (the "Modified Terms") will be posted on the Website or made available within the Service (for any modified additional terms). If you do not agree to the Modified Terms you must stop using the Service. Your continued use of the Service after the date the Modified Terms are posted will constitute your acceptance of the Modified Terms.
4.2 These Terms were most recently updated on 18.07.2025.
5.1 In order to access some features of the Website or other elements of the Service, you will have to create a Wordwall account. When creating your account, you must provide accurate and complete information. It is important that you must keep your Wordwall account password secure and confidential. You must not disclose it to any third party.
5.2 You must notify Wordwall immediately of any breach of security or unauthorised use of your Wordwall account that you become aware of.
5.3 You agree that you will be solely responsible (to Wordwall, and to others) for all activity that occurs under your Wordwall account. You are also responsible for ensuring that all persons who access the Website through your internet connection are aware of these Terms and that they comply with them.
5.4 Wordwall may from time-to-time contact you using the email address, school address and telephone numbers supplied by you regarding their products and those of third parties, if you have expressly consented to do so or you have provided implied consent (e.g. by contacting us). You may contact us via privacy@wordwall.net if you do not wish to receive such communications.
5.5 We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.
6.1 Wordwall hereby grants you permission to access and use the Service, subject to the following express conditions, and you agree that your failure to adhere to any of these conditions shall constitute a breach of these Terms on your part:
6.1.1 you agree not to distribute any part of or parts of the Website or the Service, including but not limited to any Content, in any medium without Wordwall's prior written authorisation, unless Wordwall makes available the means for such distribution through functionality offered by the Service;
6.1.2 you agree not to alter or modify any part of the Website or any of the Service;
6.1.3 you agree not to access Content through any technology or means other than the Wordwall activity pages or such other means as Wordwall may explicitly designate for this purpose;
6.1.4 you agree not to (or attempt to) circumvent, disable or otherwise interfere with any security related features of the Service or features that (i) prevent or restrict use or copying of Content or (ii) enforce limitations on use of the Service or the content accessible via the Service;
6.1.5 you agree not to use the Service for any of the following commercial uses unless you obtain Wordwall's prior written approval:
6.1.5.1 the sale of access to the Service
6.1.5.2 the sale of advertising, sponsorships or promotions placed on or within the Service, or Content;
6.1.5.3 the sale of advertising, sponsorships or promotions on any page of an ad-enabled blog or website containing Content delivered via the Service unless other material not obtained from Wordwall appears on the same page and is of sufficient value to be the basis for such sales
6.1.6 prohibited commercial uses shall not include (i) uploading educational content to the Website; (ii) using educational content contained within the Website, within the course of a lesson
6.1.7 if you use the Wordwall Player on your website may not modify, build upon or block any portion or functionality of the Wordwall Player including but not limited to links back to the Website;
6.1.8 you agree not to use or launch any automated system (including, without limitation, any robot, spider or offline reader) that accesses the Service in a manner that sends more request messages to the Wordwall servers in a given period of time than a human can reasonably produce in the same period by using a publicly available, standard (i.e. not modified) web browser;
6.1.9 you agree not to collect or harvest any personal data of any user of the Website or any Service (and agree that this shall be deemed to include Wordwall account names) save to the extent that teachers may collect details about their own students where they have appropriate grounds in providing this service through the school to pupils;
6.1.10 you agree not to use the Website or the Services (including the comments and email features in the Website) for the solicitation of business in the course of trade or in connection with a commercial enterprise;
6.1.11 you agree not to solicit, for commercial purposes, any users of the Website with respect to their Content; and
6.1.12 you agree not to access Content or any reason other than your personal, non-commercial use solely as intended through and permitted by the normal functionality of the Service.
6.1.13 You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of Wordwall or the respective licensors of the Content.
6.2 Wordwall grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. Wordwall reserves the right to revoke these exceptions either generally or in specific cases.
6.3 Wordwall is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Service which Wordwall provides may change from time to time without prior notice to you.
6.4 As part of this continuing innovation, you acknowledge and agree that Wordwall may stop (permanently or temporarily) providing the Service (or any features within the Service) to you or to users generally at Wordwall's sole discretion, without prior notice to you. You may stop using the Service at any time. You do not need to specifically inform Wordwall when you stop using the Service.
6.5 You agree that you are solely responsible for (and that Wordwall has no responsibility to you or to any third party for) any breach of your obligations under the Terms and for the consequences (including any loss or damage which Wordwall may suffer) of any such breach.
7.1 Wordwall respects the copyright of third parties. It will remove any content which is identified as belonging to a third party - you can do this by contacting us via email.
7.2 As part of Wordwall's copyright policy, Wordwall will terminate user access to the Service if a user has been determined to be an infringer.
8.1 As a Wordwall account holder you may submit Content. You understand that whether or not Content is published, Wordwall does not guarantee any confidentiality with respect to Content.
8.2 You retain all of your ownership rights in your Content, but you are required to grant limited licence rights to Wordwall and other users of the Service. These are described in paragraph 18 of these Terms (Rights you licence).
8.3 You understand and agree that you are solely responsible for your own Content and the consequences of posting or publishing it. Wordwall does not endorse any Content or any opinion, recommendation, or advice expressed therein, and Wordwall expressly disclaims any and all liability in connection with Content.
8.4 You represent and warrant that you have (and will continue to have) all necessary licenses, rights, consents, and permissions which are required to enable Wordwall to use your Content for the purposes of the provision of the Service by Wordwall, and otherwise to use your Content in the manner contemplated by the Service and these Terms.
8.5 You agree that you will not post or upload any Content which contains material which it is unlawful for you to possess in the country in which you are resident, or which it would be unlawful for Wordwall to use or possess in connection with the provision of the Service.
8.6 You agree that Content you submit to the Service will not contain any third party copyright material, or material that is subject to other third party proprietary rights (including rights of privacy or rights of publicity), unless you have a formal licence or permission from the rightful owner, or are otherwise legally entitled, to post the material in question and to grant Wordwall the licence referred to in paragraph 18 below.
8.7 On becoming aware of any potential violation of these Terms, Wordwall reserves the right (but shall have no obligation) to decide whether Content complies with the content requirements set out in these Terms and may remove such Content and/or terminate a User's access for uploading Content which is in violation of these Terms at any time, without prior notice and at its sole discretion.
8.8 You further understand and acknowledge that in using the Service, you may be exposed to Content that is factually inaccurate, offensive, indecent, or otherwise objectionable to you. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Wordwall with respect to any such Content.
8.9 The Website may include information and materials uploaded by other users. This information and these materials have not been verified or approved by us. The views expressed by other users on the Website do not represent our views or values.
9.1 We have reporting mechanisms in place to allow users to complain about or report illegal content. This is how we protect users from encountering illegal content.
9.2 We minimise the length of time for which terrorism content is present on the site. We will swiftly take down terrorism content when we find out about it.
9.3 We will minimise the length of time for which child sexual exploitation and abuse content is present on the site. We will swiftly take down child sexual exploitation and abuse content when we find out about it.
9.4 We will minimise the length of time for which other content that amounts to an offence is present on the site. This applies to content relating to assisting suicide, threats to kill, public order offences, harassment, stalking and fear or provocation of violence, drugs and psychoactive substances, firearms and other weapons, assisting illegal immigration, human trafficking, sexual exploitation, sexual images, proceeds of crime, fraud, financial services, foreign interference, animal welfare and offences relating to being involved in committing any of these offences (known as inchoate offences). We will swiftly take down such content when we find out about it.
10.1 Users who are also contributors of Content, on the Service are solely responsible and liable for moderating their Content and ensuring that it is age-appropriate for the intended recipients. In particular, such users must ensure that the following is not uploaded, shared or generated directly on this Service:
10.1.1 Pornographic content.
10.1.2 Content which encourages, promotes or provides instructions for suicide.
10.1.3 Content which encourages, promotes or provides instructions for an act of deliberate self-injury.
10.1.4 Content which encourages, promotes or provides instructions for an eating disorder or behaviours associated with an eating disorder.
10.1.5 By pornographic content, we mean any pornographic content except where it consists:
10.1.5.1 Only of text.
10.1.5.2 Only of text accompanied by identifying content which consists only of text, other identifying content which is not itself pornographic content, a GIF which is not itself pornographic content, an emoji or other symbol, or any combination of this content.
10.1.6 We have reporting mechanisms in place to allow users to complain about or report prohibited content.
11.1 We have reporting mechanisms in place to allow users to complain about or report harmful content. This is how we protect children from encountering the following types of harmful content. The following types of content might be harmful bearing in mind the child's age group:
11.1.1 Content which is abusive and which targets any of the following characteristics:

12.1.2 When you think we are not dealing with illegal content or activity as we should.

12.1.4 When you think we are not dealing with our duties to protect children as we should.
12.1.5 Where you think our content reporting systems and processes do not easily let users report content they believe to be illegal and content they believe to be harmful to children and that is accessible to children.
12.1.6 When you think we have insufficiently considered the importance of protecting users' rights to freedom of expression or privacy.
12.1.7 Where your content has been taken down on the basis that it is illegal.
12.1.8 Where we have given you a warning, suspended, banned or restricted you in any way as a result of your content which we consider to be illegal content.
12.1.9 Technology we use results in your content being taken down, access-restricted or deprioritised and you think the technology has been used in a way not set out in these Terms.
12.1.10 Where your content has been removed or access-restricted on the basis that it is harmful to children.
12.1.11 Where we have given you a warning, suspended, banned or restricted you in any way as a result of your content which we consider to be harmful to children.
12.1.12 Where you are unable to access content because we have incorrectly assessed your age.

15.1 If we restrict access to any content you generate or upload to or share on our service in a way that breaches these Terms, you have a right to bring a claim against us for breach of contract.
16.1 If we suspend or ban you from using our service in a way that breaches these Terms, you have a right to bring a claim against us for breach of contract.
17.1 You acknowledge that your experience of our Service and its pricing may differ from that of other users as part of our ongoing price testing which we carry out to improve our Service.
18.1 When you upload or post Content to Wordwall, you grant:
18.1.1 to Wordwall, a worldwide, non-exclusive, royalty-free, transferable licence (with right to sub-licence) to use, reproduce, distribute, prepare derivative works of, display, and perform that Content in connection with the provision of the Service and otherwise in connection with the provision of the Service and Wordwall's business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels;
18.1.2 to each user of the Service, a worldwide, non-exclusive, royalty-free licence to access your Content through the Service, and to use, reproduce, distribute, prepare derivative works of, display and perform such Content to the extent permitted by the functionality of the Service and under these Terms.
18.2 The above licenses granted by you in Content are perpetual and irrevocable but are otherwise without prejudice to your ownerships rights, which are retained by you as set out in paragraph 8.2 above.
19.1 With the exception of Content submitted to the Service by you, all other Content on the Service is either owned by or licensed to Wordwall, and is subject to copyright, trade mark rights, and other intellectual property rights of Wordwall or Wordwall's licensors. Any third party trade or service marks present on Content not uploaded or posted by you are trade or service marks of their respective owners. Such Content may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purpose whatsoever without the prior written consent of Wordwall or, where applicable, Wordwall's licensors. Wordwall and its licensors reserve all rights not expressly granted in and to their Content.
20.1 The Service may include hyperlinks to other web sites that are not owned or controlled by Wordwall. Wordwall has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.
20.2 You acknowledge and agree that Wordwall is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or other materials on or available from such web sites or resources.
20.3 You acknowledge and agree that Wordwall is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.
20.4 Wordwall encourages you to be aware when you leave the Service and to read the terms and conditions and privacy policy of each other website that you visit.
20.5 You may link to the Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
20.6 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
20.7 You must not establish a link to the Website in any website that is not owned by you.
20.8 The Website must not be framed on any other site, nor may you create a link to any part of the Website other than the home page.
20.9 We reserve the right to withdraw linking permission including to assignment links and embed links without notice.
20.10 Where the Website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.
20.11 We have no control over the contents of those sites or resources.
21.1 Where a School, Teacher, or other educational institution (the "Educational User") registers or uses the Service for or on behalf of pupils or students under the age of 18 ("Children"), the Educational User hereby expressly warrants and represents that:
21.1.1 It has obtained all required consents, authorisations, or permissions from the parent(s) or legal guardian(s) of each Child as necessary under all applicable data protection and privacy laws, including but not limited to the UK GDPR, the Data Protection Act 2018, and any local requirements in the School's jurisdiction;
21.1.2 Such parental or guardian consents have been obtained prior to the Child's use of the Service, and the Educational User shall retain appropriate records evidencing such consents, and shall provide evidence of same to Wordwall upon reasonable request;
21.1.3 The Educational User has provided, or will provide, all parents or guardians of Children with adequate notice regarding the nature and purposes of personal data processing in accordance with Wordwall's Privacy Policy and these Terms of Service;
21.1.4 The Educational User will fulfil all obligations owed to parents or legal guardians under applicable data protection law, including but not limited to: facilitating data subject rights requests by parents or guardians (such as access, correction, erasure, or objection), and making available Wordwall's contact details for the exercise of such rights.
21.2 Wordwall relies on each Educational User's representation and warranty in this regard. The Service may be suspended or terminated, in whole or in part, by Wordwall without notice if Wordwall reasonably believes that any Educational User is in breach of the obligations in this clause.
22.1 UK00918195621 and UK00002488001 are UK registered trade marks of Visual Education Limited. You are not permitted to use them without our approval.
23.1 We do not guarantee that the Website will be secure or free from bugs or viruses.
23.2 You are responsible for configuring your information technology, computer programs and platform to access the Website. You should use your own virus protection software.
23.3 You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with the Website or any part of it. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website or any other equipment or network connected with the Website. You must not interfere with, damage or disrupt any software used in the provision of the Website or any equipment or network or software owned or used by any third party on which this Website relies in any way. You must not attack the Website via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.
24.1 The Terms will continue to apply until terminated by either you or Wordwall as set out below.
24.2 If you want to terminate your legal agreement under these Terms with Wordwall, you may do so by (a) notifying Wordwall at any time and (b) closing your Wordwall account. Your notice should be sent, in writing, to Wordwall's address which is set out at the beginning of these Terms.
24.3 Wordwall may at any time terminate its legal agreement with you under these Terms if:
24.3.1 you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms); or
24.3.2 Wordwall is required to do so by law (for example, where the provision of the Service to you is, or becomes, unlawful); or
24.4 Wordwall may terminate its legal agreement with you under these Terms if:
24.4.1 Wordwall is transitioning to no longer providing the Service to users in the country in which you are resident or from which you use the Service; or
24.4.2 the provision of the Service to you by Wordwall is, in Wordwall's opinion, no longer commercially viable and in the case of each of 24.4.1 and 24.4.2 of this paragraph 24.4 shall, where possible, give reasonable notice of such termination.
24.5 When these Terms come to an end, all of the legal rights, obligations and liabilities that you and Wordwall have benefited from, been subject to (or which have accrued over time whilst the Terms have been in force) or which are expressed to continue indefinitely, shall be unaffected by this cessation, and the provisions of paragraph 27.5 shall continue to apply to such rights, obligations and liabilities indefinitely.
25.1 Nothing in the Terms shall affect any statutory rights that you are always entitled to as a consumer and that you cannot contractually agree to alter or waive.
25.2 The Service is provided "as is" and Wordwall makes no warranty or representation to you with respect to them.
25.3 In particular Wordwall does not represent or warrant to you that:
25.3.1 your use of the Service will meet your requirements,
25.3.2 your use of the Service will be uninterrupted, timely, secure or free from error,
25.3.3 any information obtained by you as a result of your use of the Service will be accurate or reliable, and
25.3.4 that defects in the operation or functionality of any software provided to you as part of the Service will be corrected.
25.4 No conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the Service except to the extent that they are expressly set out in the Terms.
26.1 Nothing in these Terms shall exclude or limit Wordwall's liability for losses which may not be lawfully excluded or limited by applicable law.
26.2 Subject to paragraph 26.1, Wordwall's total aggregate liability shall not exceed the value of the sums paid by you under these Terms.
26.3 Subject to the overall provision in paragraph 26.1 above Wordwall shall not be liable to you for:
26.3.1 any indirect or consequential losses which may be incurred by you. This shall include; (i) any loss of profit (whether incurred directly or indirectly); (ii) any loss of goodwill or business reputation; (iii) any loss of opportunity; or (iv) any loss of data suffered by you;
26.3.2 any loss or damage which may be incurred by you as a result of:
26.3.2.1 any reliance placed by you on the completeness, accuracy or existence of any advertising, or as a result of any relationship or transaction between you and any advertiser or sponsor whose advertising appears on the Service;
26.3.2.2 any changes which Wordwall may make to the Service, or for any permanent or temporary cessation in the provision of the Service (or any features within the Service);
26.3.2.3 the deletion of, corruption of, or failure to store, any Content and other communications data maintained or transmitted by or through your use of the Service;
26.3.2.4 your failure to provide Wordwall with accurate account information;
26.3.2.5 your failure to keep your password or Wordwall account details secure and confidential.
26.4 The limitations on Wordwall's liability to you in paragraph 26.2 above shall apply whether or not Wordwall has been advised of or should have been aware of the possibility of any such losses arising.
27.1 The Terms and the Website Privacy Policy and Cookie Policy constitute the whole legal agreement between you and Wordwall and govern your use of the Service and completely replace any prior agreements between you and Wordwall in relation to the Service. All other terms of service that Google Inc. and any of its subsidiaries may have in place from time to time are expressly excluded from the Terms.
27.2 You agree that Wordwall may provide you with notices, including those regarding changes to the Terms, by email, regular mail, or postings on the Service.
27.3 You agree that if Wordwall does not exercise or enforce any legal right or remedy which is contained in the Terms (or which Wordwall has the benefit of under any applicable law), this will not be taken to be a formal waiver of Wordwall's rights and that those rights or remedies will still be available to Wordwall.
27.4 We may transfer our rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
27.5 If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and enforceable.
27.6 No other person or company shall be a third party beneficiary of the Terms.
27.7 The Terms, and your relationship with Wordwall under the Terms, shall be governed by English law. You and Wordwall agree to submit to the exclusive jurisdiction of the courts of England & Wales to resolve any legal matter arising from the Terms. Notwithstanding this, you agree that Wordwall shall still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction.
